Patent war between NIKE Vs. LULULEMON has reached to the court. Nike has made an allegation on the lululemon for stealing their patented Flyknit technology, and asserted three patent against the Lululemon (US8266749, US9375046, US9730484) for the four infringing products of the lululemon

What Nike is claiming
Without Nike authorization, lululemon makes, uses, offers for sale, sells, and/or imports into the United States products that practice the claimed inventions of the asserted patents. Nike is claiming economic harm
Counter action by Lululemon
Lululemon disagrees with the Nike and also initiated invalidation proceeding against the -Nike in Patent Trial Appellate Board. They are exercising all the legal options available to them
Lawsuits over IP rights are common in the footwear space and can take years to resolve. Time will tell us that Lululemon has really stealed the technology or Nike is just trying to kill their competitor
Litigious FLYKNIT Technology
Nike had filed a litigation cases in Oregon and ITC on this technology against Adidas in past. Adidas failed to prove invalidation and lost the case in appeal court in 2020. Later on Nike and Adidas had settled matter outside the court. Both parties have agreed to drop all litigation against each other.
Legal is battle on this technology is always remain the talk of a town. We have to wait and see the counter strategy of Lululemon in defense.
